How to Register a Trademark in India

Registering a trademark in India is a well-defined process, but the details — the right class, a timely objection reply, the opposition window — are where applications succeed or fail. Here is the whole path, step by step.

The process below follows the Indian Trade Marks Registry (IP India). It mirrors the wider trademark lifecycle, with the practical actions you need to take at each step.

Filing in the US or UK instead? The steps are similar, but the deadlines and examination differ — the USPTO gives you 3 months to answer an objection and weighs use in commerce heavily, while the UKIPO examines only absolute grounds and runs a shorter opposition window. See the side-by-side comparison in the trademark lifecycle and objection & opposition guides.

2

Pick your class

Identify the NICE class or classes that match the goods and services you sell. Filing in the wrong class means your registration may not cover what you actually do. If your brand spans categories, plan for a multi-class application.

3

File the application

File online through the IP India portal. You will need the applicant details, a clear representation of the mark, the class(es), the goods/services description, the date of first use (if already in use), and a signed Power of Attorney (Form TM-48) if an agent is filing for you. A permanent application number is issued immediately, and you can start using the ™ symbol.

4

Examination

An examiner reviews the mark and issues an examination report, usually within a few months. If they raise an objection, you must file a reply — normally within 30 days. Many applications clear this stage with a well-argued response; some go to a show-cause hearing.

5

Publication

Once accepted, the mark is advertised in the Trade Marks Journal. This opens a four-month window during which any third party can oppose the registration. If no one does, the mark moves forward.

6

Registration

With the opposition window passed (or an opposition defeated), the Registry issues the registration certificate. Your mark is protected for 10 years, you may use the ® symbol, and you should diary the renewal date.

Cost & timeline

Two questions everyone asks: what does it cost, and how long does it take? The government fee is charged per class, with concessional rates for individuals, startups and small enterprises. Timing depends entirely on whether anyone objects: an uncontested mark can register in 6–12 months, while an objection with a hearing, or a full opposition, can push it past two years.

Once registered, the work is not over. A trademark must be renewed every 10 years, and monitored for infringers and status changes in between. Setting up status monitoring and a deadline calendar from day one is the easiest way to keep the mark alive.

Frequently Asked Questions

How much does it cost to register a trademark in India?

The government filing fee is per class. As of writing, it is lower for individuals, startups and small enterprises than for larger companies. Professional or attorney fees are separate. Because fees are charged per class, filing across multiple classes multiplies the cost.

How long does trademark registration take in India?

In a smooth case with no objection or opposition, registration typically takes 6–12 months. An objection that needs a hearing, or an opposition, can extend this to two years or more.

Can I register a trademark myself without a lawyer?

Yes, individuals can file directly through the IP India portal. However, an incorrect class, a weak objection reply or a missed deadline can cost you the application, so many applicants use an agent or attorney — especially if an objection is raised.

Do I need to have used the mark before filing?

No. You can file on a "proposed to be used" basis before you launch, or claim an earlier date of first use if the mark is already in the market. Claiming genuine prior use can strengthen your position.
